When your vehicle leaves a collision repair shop, the parts inside it may not be what the manufacturer originally put there - and there is a reasonable chance nobody told you that before work began. Replacement part decisions happen quietly, embedded in estimate line items that most drivers sign without reading carefully. Your insurer has a financial preference for cheaper alternatives, and the default settings in estimating software often reflect that preference without flagging it. New York law already gives drivers specific, enforceable rights on this question - rights that insurers do not typically advertise. Understanding them before you file a claim costs nothing; discovering them after the fact often costs more.
The Three Categories of Replacement Parts
Your written estimate should specify what category each replacement part falls into. Here is what each label actually means.
New OEM parts come from the vehicle's manufacturer or an authorized supplier, identical to what left the factory. They carry manufacturer warranty coverage and meet all original specifications for fit, finish, and structural performance. They are also the most expensive option, which is why insurers frequently prefer the alternatives.
New certified aftermarket parts come from third-party manufacturers but carry independent certification from either CAPA (Certified Automotive Parts Association) or NSF International. CAPA, a nonprofit founded in 1987, has certified over 195 million replacement parts through a program that verifies fit, finish, corrosion resistance, and structural integrity against OEM benchmarks. NSF runs a separate ANSI-accredited program that major insurers recognize. A CAPA or NSF seal means a third party has tested the part against documented standards - a meaningful distinction from uncertified parts.
New uncertified aftermarket parts - listed in some estimating software as "competitive" parts - carry no independent certification and have not been tested for dimensional accuracy, corrosion resistance, or structural performance. This is the highest-risk category for quality variation. Some insurers' estimating software defaults to these parts unless the shop or the owner actively pushes back.
Recycled parts, also sold under the label LKQ (like kind and quality), are used OEM parts pulled from salvage vehicles. They are genuine manufacturer parts but carry the age-related wear of whatever vehicle they came from. The expectation is that they match the age and condition of your damaged component - an assumption worth scrutinizing for any structural component.
Remanufactured parts are used components rebuilt to a specification. More common in mechanical repair than collision work, they occupy a middle ground between new and recycled in both price and quality assurance.

What New York Law Already Requires
New York's Motor Vehicle Repair Shop Registration Act, codified at Vehicle and Traffic Law §398-D, establishes enforceable rights you have on any collision repair today - no pending legislation required.
Every licensed repair shop in New York must provide a written estimate before starting work, and that estimate must identify each replacement part by type: new OEM, new aftermarket, recycled, or remanufactured. The final invoice must do the same. This applies to every repair, not just major ones. If your estimate has a line item without a part-type designation, that is a disclosure violation, not a technicality to overlook.
On the insurer side, existing New York law prohibits any insurer from directly or indirectly requiring a specific type of replacement part without first disclosing that part type to you. Insurers can legally specify aftermarket parts - that practice is permitted - but they cannot do it without telling you what they are specifying.
Two additional protections under §398-D require your active participation. First, if the actual repair cost will exceed the written estimate, the shop must contact you for authorization before continuing. You are not obligated to approve the increase. Second, if you want the parts removed from your vehicle returned to you after the repair, you must make that request in writing before work begins. Once those parts leave the shop - to a recycler, a core exchange, or a landfill - your right to them is gone. If you have any reason to believe a parts dispute might arise, a written request before the first bolt is turned gives you physical evidence of what came off your car.
New York Insurance Law §3411(k) provides a formal dispute path that insurers rarely advertise. If you disagree with your insurer's damage valuation or repair scope, you can invoke the appraisal clause. Each side selects an independent appraiser; if those two cannot agree, a neutral umpire renders a binding decision. This is a real mechanism with teeth, not a suggestion to negotiate politely.
New York also has a statute of limitations on property damage claims - check with an attorney for the applicable period, since statutes can change and exceptions apply - but the window may be longer than you expect. A driver who discovers months later that a repair used undisclosed non-OEM parts may still have recourse.
What's Pending in Albany: Bills S4753, A75, and AB245
Two companion bills - Senate Bill S4753 and Assembly Bill A75 - are active in the 2025-2026 New York legislative session and would substantially raise the floor on what current law requires.
Under S4753/A75, any vehicle in the year of manufacture plus the two following calendar years would require OEM parts for collision repairs. For vehicles outside that window, the bills would require written owner consent before any non-OEM part could be used - shifting the current disclose-and-proceed standard to an affirmative consent standard. An insurer specifying a cheaper part would need your signature, not just a line on an estimate you may not have read carefully.
Assembly Bill 245 addresses repair procedures rather than just parts. It would require written owner authorization before a shop completes any repair that deviates from the vehicle manufacturer's OEM repair procedures - covering the methods used, the sequence of steps, and the techniques applied. Structural repairs follow manufacturer specifications designed to restore a vehicle's crash performance, and AB245 would give owners a formal role in approving any deviation from those specifications.
None of this represents new advocacy. Predecessor bills have been introduced in the New York legislature repeatedly since 2009 without either chamber passing them. The pattern reflects a durable standoff between insurers arguing that aftermarket parts keep premiums manageable and collision shops and consumer advocates arguing that undisclosed substitution affects safety and vehicle value. The current session may or may not break that pattern. Capital District drivers cannot plan around legislation that has not passed; the rights under §398-D are the ones you can act on today.

The Safety Evidence: Certified vs. Uncertified Aftermarket
The safety picture on aftermarket parts is more differentiated than the debate usually reflects.
A 2023 NHTSA Component Substitution Study tested 112 certified aftermarket parts across 14 vehicle platforms and found that 94% of CAPA- and NSF-certified structural parts met or exceeded OEM deformation thresholds in front-offset impact tests. That data comes from a federal safety agency and covers structural components - the category where the stakes are highest. The Insurance Institute for Highway Safety reviewed a 2018 crash test study on a Honda Fit repaired with non-OEM aftermarket parts and concluded the vehicle performed on par with IIHS's prior evaluation of the same model, though IIHS noted limitations in the test methodology.
The critical distinction is between certified and uncertified parts. CAPA- and NSF-certified parts have been measured against documented standards. Uncertified "competitive" parts have not. Whether a given uncertified part fits correctly, resists corrosion, or behaves as expected in a crash is unknown - to you, your shop, and your insurer. Some fit and function acceptably; others don't. There is no independent basis for knowing in advance.
The risk profile also shifts by part type. Certified aftermarket cosmetic parts - fenders, door skins, hoods that carry no structural load - are widely accepted as functionally equivalent by OEM-certified repair programs. Structural components are held to a different standard. Frame rails, pillars, and crush zones are engineered to deform in a specific sequence to absorb collision energy and protect occupants. OEM-certified repair programs from manufacturers including Toyota, Honda, and Tesla specify OEM parts for structural repairs because the engineering was done against known material and dimensional properties. Substituting an uncertified part introduces variables those calculations never accounted for.
The ADAS Complication
Modern vehicles increasingly embed sensor hardware in the body panels most likely to be damaged in a collision. Forward collision cameras sit near A-pillars. Radar modules mount behind bumper fascias and grille openings. LiDAR sensors on some vehicles occupy locations that once held only plastic trim. After a front or rear collision, these sensors require recalibration - a precise alignment process that depends on the surrounding panel geometry being dimensionally correct.
This is where non-OEM part variation becomes a safety issue rather than a cost question. If a replacement bumper cover positions a radar module's mounting point even slightly off from the OEM specification, the sensor's detection zone shifts. A recalibration procedure that passes all software checks may still miss this if the bracket itself is mislocated. The system reports normal operation while the actual detection field is displaced from where the driver expects it to be.
Manufacturers publish part and procedure specifications for sensor-bearing panels because they validated the full system - sensor, bracket, panel, and calibration target - as an integrated unit. Non-OEM alternatives, particularly uncertified ones, have not been tested in that system context.
If your vehicle has forward collision warning, automatic emergency braking, adaptive cruise control, or lane-keeping assist, and your repair involves panels near those sensors, ask explicitly before authorizing work: Is the replacement panel OEM or certified aftermarket? How will ADAS recalibration be verified after installation? Get the answers in writing.

How to Protect Yourself When Filing a Claim
The moment most drivers lose leverage is when they hand over their keys and sign an estimate without reading it. These steps change that.
- Read the estimate before signing. Each part should be labeled as new OEM, new aftermarket (and whether certified), recycled, or remanufactured. A line item that says only "part" with no type designation is incomplete - ask for clarification before authorizing anything.
- Ask about certifications on aftermarket parts. "New aftermarket" covers a wide range. Ask specifically whether each aftermarket part is CAPA- or NSF-certified. Ask for the part number if you want to verify independently.
- Request OEM parts in writing if you want them. You have the right to request OEM parts; put it in writing and keep a copy. Your insurer may not pay the difference in cost, leaving you to cover that gap - but that is your decision to make with full information, not a default the estimating software made for you.
- Request your removed parts in writing before work begins. Under V&T Law §398-D, this right vanishes once work starts. The original damaged parts provide physical evidence in a dispute and document exactly what the vehicle contained before the repair.
- Invoke appraisal if a dispute becomes serious. Under Insurance Law §3411(k), you can formally demand the appraisal process. Each side appoints an independent appraiser; a neutral umpire decides if they disagree. The outcome is binding - this is the formal escalation path when negotiating stops producing results.
- Document your vehicle's ADAS features before any claim. Knowing which sensors your vehicle has and where they are located gives you a specific, factual basis for requesting OEM or certified aftermarket parts on sensor-bearing panels.
When Aftermarket Makes Sense - and When It Doesn't
Insisting on OEM parts for every repair on every vehicle is not always the most practical position, and treating all aftermarket parts as equivalent is not accurate either.
Certified aftermarket cosmetic parts on older vehicles can represent a reasonable tradeoff. A CAPA-certified fender on a vehicle well past manufacturer warranty, replacing a part that carries no structural load and sits nowhere near a sensor, is a case where cost savings are real and the practical difference is small. Pushing hard for OEM in that scenario may not be worth the effort or the out-of-pocket premium.
The calculation shifts in specific situations. Vehicles still under the manufacturer's warranty often require OEM parts to preserve coverage - check your warranty documentation, because some manufacturers limit coverage on systems affected by non-OEM repairs. Structural components in crumple zones are where OEM justification is strongest, at any vehicle age. Any panel that houses or supports an ADAS sensor is another category where OEM, or certified aftermarket at minimum, is a defensible and practical request. Uncertified "competitive" parts are rarely worth accepting in any scenario - the cost savings come with no quality assurance whatsoever.
If your insurer specifies uncertified parts and you want to push back without going to full OEM cost, requesting certified aftermarket as a middle ground is a reasonable negotiating position. Many adjusters will accept it without significant resistance. You are not always choosing between taking whatever the software generated and paying the full price difference yourself.
The Capital District Takeaway
New York already gives drivers specific, enforceable rights that most people never knew they had. Part-type disclosure on every written estimate is a legal requirement under V&T Law §398-D, not a professional courtesy. The prohibition on insurers requiring part types without disclosure is current, enforceable law. These rights don't depend on S4753/A75 passing - they apply today, on any repair authorized at a licensed shop in New York state.
Before authorizing any collision repair at any shop, ask three things: What is the category of each replacement part, and if it is aftermarket, is it CAPA- or NSF-certified? Does my vehicle have ADAS sensors near the damaged area, and how will recalibration be confirmed after the repair? If a dispute arises over my repair scope, what formal recourse do I have? A CDAA member shop should answer all three questions directly and in writing before a single panel comes off your car.
The bills in Albany - S4753/A75 and AB245 - represent where advocacy has been pushing for well over a decade. Whether this session produces a different outcome is worth watching. But the rights you have right now, under existing law, are real, practical, and available on your next claim. Read your estimate. Know what you are authorizing. And if your insurer disputes the repair scope, remember that you have an appraisal right that bypasses the adjuster's desk entirely.
